Tumbell Terms of Use
Welcome to Tumbell! These Terms of Use (the "Terms") govern your access to and use of our dating platform ("Tumbell," "we," "our," or "us"). By accessing or using Tumbell, you agree to comply with these Terms. If you do not agree with these Terms, please do not use our platform.
To use Tumbell, you must be at least 18 years old and legally capable of entering into a binding agreement. By using Tumbell, you represent and warrant that you meet these requirements. If you do not meet these requirements, you must not access or use Tumbell.

Tumbell reserves the right to investigate and take appropriate legal action against anyone who, in Tumbell's sole discretion, violates these Terms, including without limitation, removing the offending content from Tumbell, suspending or terminating the account of such violators, and reporting you to law enforcement authorities.
You are responsible for the content you post on Tumbell. By posting content, you grant Tumbell a non-exclusive, transferable, sub-licensable, royalty-free, worldwide license to use, copy, modify, distribute, and display such content in connection with the operation of Tumbell.
You agree not to post content that:
- Is offensive, defamatory, or otherwise inappropriate.
- Infringes on the intellectual property rights of others.
- Contains nudity, violence, or explicit content.
- Promotes discrimination, hatred, or harm against any individual or group.
Tumbell reserves the right to remove any content that violates these Terms or is otherwise objectionable at our sole discretion. We do not, however, undertake any obligation to monitor user content or assume any liability for user content.

To the fullest extent permitted by law, Tumbell, its affiliates, and their respective directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses, resulting from (i) your use or inability to use Tumbell; (ii) any unauthorized access to or use of our servers and/or any personal information stored therein; (iii) any bugs, viruses, trojan horses, or the like that may be transmitted to or through Tumbell by any third party; (iv) any errors or omissions in any content or for any loss or damage incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through Tumbell; and/or (v) user content or the defamatory, offensive, or illegal conduct of any third party.
In no event shall Tumbell, its affiliates, or their respective directors, employees, or agents be liable for any claims, proceedings, liabilities, obligations, damages, losses, or costs in an amount exceeding the amount you paid to Tumbell hereunder or $100.00, whichever is greater.
These Terms are governed by and construed in accordance with the laws of the jurisdiction in which Tumbell operates, without regard to its conflict of law principles. You agree to submit to the personal and exclusive jurisdiction of the courts located within that jurisdiction.
Tumbell may modify these Terms from time to time. We will notify you of any changes by posting the new Terms on our platform. You are advised to review these Terms periodically for any changes. Your continued use of Tumbell after the posting of changes constitutes your acceptance of such changes. If you do not agree to the modified Terms, you should discontinue your use of Tumbell.

As a user of Tumbell, you agree to:

The compilation of all content on this site is the exclusive property of Tumbell and protected by international copyright laws. All software used on this site is the property of Tumbell or its software suppliers and protected by international copyright laws.
Tumbell may contain links to third-party websites or resources. You acknowledge and agree that we are not responsible or liable for:
- The availability or accuracy of such websites or resources.
- The content, products, or services on or available from such websites or resources.
Links to such websites or resources do not imply any endorsement by Tumbell of such websites or resources or the content, products, or services available from such websites or resources. You acknowledge sole responsibility for and assume all risk arising from your use of any such websites or resources.
You agree to defend, indemnify, and hold harmless Tumbell, its affiliates, and their respective directors, employees, and agents from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from:
- Your use of and access to Tumbell.
- Your violation of any term of these Terms.
- Your violation of any third-party right, including without limitation any intellectual property, property, or privacy right.
- Any claim that your content caused damage to a third party.
This defense and indemnification obligation will survive these Terms and your use of Tumbell.
